Terms of Service
1. Who we are
This service is provided by naSpotted sp. z o.o., al. Jana Pawła II 43A lok. 37B, 01-001 Warszawa, Poland, NIP (VAT ID) PL5273228667, KRS 0001255909 ("we", "us"). We run the Instagram account @worldtopdesign and sell paid features on it: a feed post or a story ("Feature").
2. Ordering and payment
You order by filling in the form, uploading your materials and paying through Stripe. The agreement is concluded when the payment is confirmed. Prices are shown before payment and are final. Stripe emails you a receipt; if you need an invoice with your company's VAT ID, contact us after paying.
3. Your materials
You confirm that you own the photos, videos and texts you upload, or have the right to publish them, and that publishing them does not infringe anyone's rights (copyright, trademarks, image rights, privacy). You grant us a non-exclusive, worldwide, royalty-free licence to publish them on @worldtopdesign, to crop and resize them for Instagram, to write and publish a caption about your product and to keep the Feature on our profile.
We do not accept: content that is not related to design, people-focused or intimate content, content involving minors, violence, hate, politics, weapons, drugs, gambling, crypto or financial promises, misleading claims, text-heavy ads, or videos with other platforms' watermarks.
4. Review and refusal
Every order is reviewed before publishing, partly with automated tools. We may refuse any order that does not fit the account or Instagram's rules. If we refuse before publishing, you receive a full refund to the original payment method, usually within 5-10 days.
5. Publication
- We show the expected publication time before you pay. It is an estimate, usually within 1-2 days. If we cannot publish within 7 days of payment, you may cancel for a full refund.
- We write the caption in the account's style and mention your account. Paid Features are marked "#ad", as the law requires.
- Feed posts stay on our profile for at least 12 months, unless removal is required by Instagram, by law or by a rights holder's complaint. Stories are visible for 24 hours, as on Instagram.
- We do not guarantee any number of views, likes, followers or sales.
6. Packages and add-ons
- A package (for example Starter or Growth) gives you a set number of feed posts and stories for one Instagram account, to use within the stated number of days from payment. Each one is ordered from your package page and reviewed like a single Feature.
- Unused credits expire at the end of the package and are not refunded. If we refuse a submission, the credit returns to your package; if this happens in the last days, we extend the package by at least 3 days.
- The dedicated Story add-on is published a few hours after your feed post. If Instagram can't publish it, we refund the add-on price. If we refuse the post before publication, the whole order is refunded.
7. Consumers
The service is meant for brands, designers and businesses. If you order as a consumer in the EU, you have 14 days to withdraw from the agreement. By ordering you ask us to start right away, and you acknowledge that you lose the right of withdrawal once the Feature has been published. Before publication you can withdraw and get a full refund. For a package, you can withdraw within 14 days for a refund of the credits you haven't used yet, valued at single-feature prices.
8. Complaints
If something is wrong with your Feature, contact us by direct message to @worldtopdesign, ideally within 14 days of publication. We reply within 14 days. A justified complaint ends with a correction, republication or refund.
9. Liability
For business customers our total liability is limited to the price paid for the order. We are not liable for Instagram's decisions (for example reach limits or removals) or for interruptions of Instagram or Stripe. Nothing in these terms limits liability that cannot be limited by law.
10. Law
These terms are governed by Polish law. If you are a consumer, you keep the protection of the mandatory rules of your country of residence. We may update these terms; the version in force when you paid applies to your order.
